Terms of Sale
By registering and bidding, you agree to be bound by these terms.
NOTICE
All Bidders and other persons attending this sale agree that they have read and have full knowledge of these terms and agree to be bound hereby. The Bidder identified by the Auctioneer as the high bidder or successful bidder at auction shall have entered into a legally binding contract to purchase the item bid upon ("Lot") at the price and subject to the terms and conditions set forth herein. All determinations, rulings, and adjustments made by the Auctioneer in good faith shall be final, binding, and conclusive upon all Bidders. The term "Auctioneer" herein means AR Auto & Equipment Auction.
01IDENTIFICATION
All Bidders are required to provide full name, address, a valid government-issued photo ID, and driver's license number at the time of registration. AR Auto & Equipment Auction reserves the right to refuse registration to any individual at its sole discretion.
02DEPOSIT
Each successful Bidder may be required to make a deposit at the time of knockdown. In default of such deposit, the Lot may be put up again immediately and resold. Deposit amounts will be announced prior to each auction.
03TIME OF PAYMENT
All invoices must be paid in full within 48 hours after the auction. Any merchandise not paid for by this time will be considered abandoned and may be resold by the auctioneer, with any loss incurred in the resale to be borne by the original buyer. In the absence of payment, title to the Lot shall not transfer and any deposit may be forfeited.
04MANNER OF PAYMENT
All payments must be made by cash, certified check, wire transfer, or ACH. Personal checks are not accepted without prior approval. All invoices must be paid to representatives of the Auctioneer at the auction site unless otherwise announced. The full purchase price must be paid before removal of any Lot.
05REMOVAL
All items must be removed within 10 days of the auction date unless noted in the lot description or approved by the Auctioneer in writing. TIME IS OF THE ESSENCE. At the Owner's discretion, any items remaining after this time will be removed and stored at the buyer's expense or considered abandoned and scrapped, or subject to storage fees of $250 PER LOT, PER DAY. NO EXCEPTIONS. Removal shall be at the expense, risk, and liability of the successful Bidder. Purchases will be released only upon presentation of a paid invoice.
06DISCLAIMER OF ALL WARRANTIES — AS-IS / WHERE-IS
The Auctioneer and any owner, seller, or secured party make no warranties, express or implied, as to merchantability or fitness for any purpose. All items are sold "AS-IS, WHERE-IS" and "WITH ALL FAULTS." There are NO REFUNDS, NO EXCHANGES, NO GUARANTEES, and NO WARRANTIES on any item. ALL SALES ARE FINAL. The Auctioneer shall not be responsible for the correct description, genuineness, or authenticity of any Lot. Buyers are strongly encouraged to inspect all items prior to bidding.
07CLAIMS
No claims will be allowed after removal of Lots from the premises.
08RESPONSIBILITY FOR NON-DELIVERY
Auctioneer, any owner, seller, or secured party shall not be liable to any Bidder for non-delivery of any Lot other than for the return of the deposit or sum paid. Damages for non-delivery are expressly limited to amounts paid; claims for lost profits, opportunity costs, or consequential damages are waived.
09COMPLIANCE WITH TERMS OF SALE
In default of payment within the time specified, the Auctioneer may retain all monies received as deposit or otherwise as liquidated damages. Lots not paid for and removed within the time allowed may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of re-sale, will be charged to the defaulting Bidder.
10RISK TO PERSON AND PROPERTY
Persons attending during exhibition, sale, or removal of Lots assume all risks of damage or loss to person and property and specifically release the Auctioneer from liability therefor. Neither the Auctioneer nor its principals shall be liable by reason of any defect in or condition of the premises on which the sale or removal is held.
11ADDITION TO OR WITHDRAWAL FROM SALE
The Auctioneer reserves the right to alter the order of sale, withdraw any Lots, add unlisted Lots, group Lots into combined selling units, or subdivide Lots — all at its sole discretion. Whenever the best interest of the Seller will be served, the Auctioneer reserves the right to sell Lots in bulk.
12DISPUTE BETWEEN BIDDERS
If any dispute arises between two or more Bidders, the Auctioneer may decide the matter or put the Lot up for sale again immediately. The Auctioneer may reject a nominal or fractional bid advance at its sole discretion.
13RESERVE
The Auctioneer reserves the right to reject any and all bids. On Lots upon which there is a reserve, the Auctioneer shall have the right to bid on behalf of the seller and shall have no obligation to announce such reserve or bid.
14RECORDS
The record of sale kept by the Auctioneer will be taken as final in the event of any dispute.
15AGENCY
The Auctioneer is acting as agent only and is not responsible for the acts of its principals.
16SALES TAX
All sales are subject to applicable state and local taxes, which will be collected from the successful Bidder unless a valid tax-exempt certificate including a tax-exempt number is presented at the time of registration and payment.
17BUYER'S PREMIUM
A 10% Buyer's Premium with a $25.00 minimum is in effect for ALL purchases. An additional 2% will be added to all online purchases. This percentage is added to the final hammer price to determine the total purchase price.
18ONLINE BIDDING
Online bidders participate through approved third-party platforms (e.g., ProxiBid). Online bids are legally binding and all Terms of Sale apply equally to online and in-person bidders. AR Auto & Equipment Auction is not responsible for technical issues that may affect online bidding.
19EXPORT DOCUMENTS
The Auctioneer cannot assist with export documents. All export compliance is the sole responsibility of the successful Bidder.
20ADDITIONAL TERMS AND CONDITIONS
The Auctioneer may modify or supplement these terms by announcement at the start of the sale or by language in the auction catalogue. Such modifications supersede these printed terms to the extent of any conflict.
